Wyrok w sprawie tagedii na Hackney Central – 19 miesiecy wiezenia dla mojego klienta oskarzonego o manslaughter

Piatek 1 listopada 2013 na Kenmure Road w Hackney Central wydarzyla sie tragedia. Na skutek jednego uderzenia S.P. Miroslaw Glaza przewraca sie i upada glowa na chodnik. Zmarl w szpitalu 6 dni pozniej. Policja aresztuje mojego klienta Rafala Lewsza zostaje oskarzony przywiezniony do Sadu na Thames i trafia na sankcje do aresztu sledczego. Pozniej bronie jego na kolejnym przesluchaniu na Stoke Newington Police Station. Nie udana proba wyjscia z aresztu z wolnej stopy w sadzie Snaresbrook Crown Court. Po wielu posiedzeniach sadowych wyrok jest odczytany 27 Marca 2014 przez Sedziego Judge William Kennedy:

’This is truly a tragic and unusual case. I accept on this particular day you met someone who you had known – you had befriended that man as a fellow national.

’You had helped him and chosen to voluntarily give him money and employment as you tried to save him from himself.

’He was deported and you lost contact with him and then suddenly met him again – it was evident from his condition that he had reverted to his old ways.

’He was drunk and homeless and I can understand your great disappointment – you spoke to him and argued about that which he had become.

’He asked you for money and despite your concern you gave him some and when you turned to walk away he was abusive.

’You were sober and he was drunk and the mistake you made was to react violently to that which had been said to you.

’I accept that you did not intend to do him serious harm but of course he was intensely vulnerable.

’He offered you no violence and his reactions were so slowed by drink, it prevented him from protecting himself as he fell.

’A man who strikes a drunk man take a terrible risk and of course as you have said yourself, this is something which you will live with for the rest of your life.

’You are a decent working man who has set out to care for your family – but you killed a man and it is for that I must deal with you.

’Yours is an extraordinary case – you did not seek to do what you did as justifiable disappointment turned to unjustifiable violence.’

Sprawy tego typu – kiedy ktos traci zycie – sa najbardziej trudne, nie tylko z wzgledu na duza odpowiedzialnosc ktora musi byc przyjeta przed adwokata ale tez przez role jaka graja emocje wszystkich ludzi zwiazanych z sprawa. Klient w takich sprawach moze trafic do wiezenia na bardzo dlugo, taktyka i obrona czlowieka w takiej pozycji wymaga doswiadczenia i przewidzenia rezultatu ruchow miesiacami do przodu. Wynik taki niski jak 19 miesiecy nie byl by mozliwy przy przegranym procesie lub gdyby oskarzenie byloby morderstwo zamiast manslaughter.
